Article 1: object

These general conditions of sale are concluded between:

Hereinafter "CORDELIA Lingerie"

and

Any individual visiting and / or wishing to purchase via the website www.cordelia-lingerie.com accessible via the URL: www.cordelia-lingerie.com

Hereinafter the "User"

These conditions are intended to define the terms of distance selling between CORDELIA Lingerie and the User, from order to payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

The order implies prior and irrevocable acceptance of the general conditions of sale. The User thus acknowledges having read, understood and accepted these conditions by checking, at the time of placing the order, the box: "I have read and I accept the general conditions of sale and I understand that carrying out this order requires payment ”.

The general conditions may be subject to modifications, the applicable conditions are those in force on the site www.cordelia-lingerie.com on the date of placing of the order by the User.

The User declares:

- Have the capacity to conclude this contract: minors are excluded, as well as persons under guardianship or curatorships without the express authorization of their legal guardian,

- Make purchases only for personal use and not purchase products for the purpose of reselling them,

- Not to be a trader.

Article 2: Products

The Products offered for sale by CORDELIA Lingerie are those appearing on the site www.cordelia-lingerie.com, on the day of consultation of the site by the User.

The Products are offered for sale while stocks last. The availability of products is checked by CORDELIA Lingerie at the time of order preparation.

In addition to the photographs reproduced and illustrating the Products presented, the User is invited to consult the description of each Product to find out their characteristics. CORDELIA Lingerie undertakes to reproduce the products as faithfully as possible; however, a slight difference from the presentation visuals cannot be completely excluded.

Article 3: Promotions

CORDELIA Lingerie provides the User with exclusive offers in stores and / or on the website www.cordelia-lingerie.com. These can be discounts or gifts.

Article 4: Price

The prices are presented in euros including VAT and excluding delivery costs which remain the responsibility of the User, except in special conditions. The delivery costs are indicated when placing the order, according to the terms of article 8.

The prices indicated take into account the VAT applicable on the day of the order. If the rate were to be changed, these changes could be reflected in the price of the Products without the User being informed in advance.

CORDELIA Lingerie reserves the right to modify its prices at any time. The Products will be invoiced on the basis of the prices in force at the time of the registration of the order.

Prices are guaranteed to be the lowest compared to the prices charged in our stores, except for special promotions specific to a store.

Article 5: Order

Any order implies express and irrevocable acceptance of the prices and descriptions of the Products available for sale. The validation of the order therefore implies express acceptance of the general conditions of sale.

5.1 Validation cart

The User selects the Products he wishes to order by clicking on the "Add to cart" box. The selected Products are then listed in the "Basket" tab. The user can thus check in this tab the details of his order (example: products, quantities, price, size, color). Once the information has been verified and / or adjusted, the User can continue their order by clicking on the "Validate basket" box.

5.2 Creating a User Account

To create a User account, the User will be asked to complete a form and provide the following mandatory information: title, surname, first name, email address, postal address, telephone number. To find out how to process the aforementioned data, the User can consult the " Personal Data " section. If he wishes, the User can again log into his account during his next visits using the identifiers provided (email address and password). However, the User can continue his order without creating a User account by logging in as a guest. The User must then obligatorily provide an email address, his civility, his name, his first name, his address and his telephone number.

5.3 Selecting the mode of delivery and payment method

Once his basket is validated, the User is required to inform the delivery method he wishes, in accordance with article 8 of these GTC. The user then selects his means of payment, in accordance with article 7 of these GTC. In order to allow the User to return to his order before confirming it definitively, CORDELIA Lingerie has created validation and acceptance screens. The order will not be definitively registered until the last validation of the payment screen of the order, that is to say once the User has accepted the general conditions of sale and clicked on the boxes:

"I have read and accept the T & Cs and I understand that making this order requires payment",
"Pay my order".

From the last click of acceptance, the order is considered irrevocable.

5.4 Order Status

A first email summarizing the choices of the User is sent as soon as the payment for the order is confirmed. A second email summarizing the Products shipped and invoiced is sent when the order is shipped. The unavailability of a Product will therefore be reported indirectly to the buyer on this e-mail. Once the order has been confirmed on the site, the User can at any time monitor its processing. To benefit from this service, the User simply has to log into his account on the site and access the "My orders and returns" section. In the event that the User places an order as a guest, that is to say without creating a User account, he can always track his order using the tracking number indicated in the email of order confirmation. Article 6: Payment

6.1 The different means of payment

The order placed on the site www.cordelia-lingerie.com can be paid by:

bank card: Credit card, Visa card, Eurocard / Mastercard / Maestro ,
Paypal account: Paypal is an easy, fast and secure way to pay for your online purchases without entering your bank details. You can also pay securely by debit advice via Paypal.

6.2 Fraud

The User is reminded that payment card fraud is an offense punishable under article L.163-3 of the Monetary and Financial Code: “Is punishable by imprisonment for seven years and a fine of 750,000 euros does it for everyone:

Counterfeit or falsify a check or other instrument mentioned in article L. 133-4;
To make or attempt to make use, knowingly, of a check or other instrument mentioned in article L. 133-4 infringing or falsified;

Article 7: Delivery terms

To facilitate the User's purchases, CORDELIA Lingerie offers the COLISSIMO delivery method:

at home in Metropolitan France and the EEC: € 5, delivery in 3 to 5 working days,
at home other than Métropole and CEE: 15 €, delivery in 3 to 8 working days,

The User is informed by email of the date of dispatch and the tracking number, allowing him to track his package on the www.colissimo.fr site by entering his number. The delivery times indicated above are only given for information. CORDELIA Lingerie cannot be held liable for late delivery, for any reason whatsoever. Consequently, no claim for compensation of any kind may be claimed by the User from CORDELIA Lingerie. However, if the delivery of the order has not taken place within the deadline, the User may ask CORDELIA Lingerie to make the delivery within a reasonable additional time by registered letter with acknowledgment of receipt. Following this request and without respecting the new deadline, the User is entitled to terminate his order by sending a registered letter with acknowledgment of receipt to CORDELIA - 9 rue de Paris - 03200 VICHY, in accordance with article L. 216-2 of the Consumer Code. Furthermore, during sales, promotions or private sales and due to the large number of orders to be processed during these periods, the order processing times may be longer.

Article 8: Retention of title clause

Until full payment of the order, CORDELIA Lingerie remains the owner of the Products ordered by the User. The risks are transferred to the delivery provider at the time of taking charge of the shipment of the order, then transferred to the User at the time of receipt of the order by the latter.

Article 9: Right of withdrawal

9.1 Information on the User's right of withdrawal

In accordance with article L.121-20-12 of the Consumer Code, the User has the possibility of exchanging the Products ordered or of obtaining a refund, if he is not entirely satisfied with them. From the date of receipt of the Product, the User has a legal period of 14 days mentioned in article L121-20-12 of the Consumer Code. Exchanges and refunds will only be accepted for unworn, unwashed Products, with their labels and in their original packaging. In addition, and in accordance with article L.221-28 of the French Commercial Code, exchanges or refunds will not be accepted for Products made according to the consumer's specifications or clearly personalized (eg engravings, embroidery, etc.).

9.2 Exercise of the right of withdrawal by the User

The User will inform CORDELIA Lingerie of his decision to withdraw by sending him, before the expiration of the legal period of 14 days:

Either the withdrawal form present in the package or downloadable at the following address: Good return .
Or any other unambiguous declaration, expressing its desire to retract by post to the following address: CORDELIA - 9 rue de Paris - 03200 VICHY.

The form or declaration must be accompanied by the products that the buyer returns. The return methods are more fully described in article 11.

Article 10: Legal guarantees

The user benefits from the guarantee of latent defects and conformity in accordance with the provisions of articles 1641 to 1649 of the civil code, L217-4 to L217-14 of the consumer code to obtain in justice the repair or the replacement of the good and if impossible, resolution or reduction of the price.

10.1 Legal warranty against hidden defects

Article 1641 of the Civil Code: "The seller is bound by the guarantee for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which so diminishes this use that the buyer would not have it not acquired, or would have given a lesser price, if he had known them ”. Article 1648 paragraph 1 of the Civil Code: "The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect".

10.2 Legal guarantee of conformity

Article L217-4 of the Consumer Code: “The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing when they are delivered. He is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter has been charged to him by the contract or has been carried out under his responsibility ”. Article L217-5 of the Consumer Code: "To comply with the contract, the product must:

Be suitable for the use normally expected of a similar item and, where applicable:
- correspond to the description given by the seller and have the qualities that the latter presented to the buyer in the form of a sample or model;
- have the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;
Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted ”.

Article L217-12 of the Consumer Code: "Action resulting from lack of conformity lapses two years after delivery of the goods".

Article 11: Terms of exchange and reimbursement

Following the exercise of the User's right of withdrawal (Article 9) or in the event of non-compliance or a defect affecting the products ordered (Article 10), the User can return the products ordered:

by physically going to one of our CORDELIA stores - 21 rue Cambon - 75001 PARIS or CORDELIA - 9 rue de Paris - 03200 VICHY, on presentation of your electronic invoice (available in the tracking of your orders on our website) and good return . The store, to the extent of its possibilities, will offer you an exchange or a refund of the item (s) at the price indicated on your invoice (possible discounts taken into account). If the item you choose is more expensive, you can settle the difference by any means of payment accepted in our CORDELIA store. The exchange is only possible by a return to the store.
by post to CORDELIA - 9 rue de Paris - 03200 VICHY, remembering to enclose with your shipment a copy of your electronic invoice (available in the tracking of your orders on our site) as well as the duly completed return slip . Upon receipt and control of your return, the returned product (s) will be refunded, by crediting the bank card or the Paypal account, which served for the initial payment of the order. The refund will appear on the account attached to the payment method used for the payment of the order. It will be visible within 4 to 5 working days (interbank deadlines).

Any initial delivery costs will be reimbursed in full only if the entire order is returned. Furthermore, CORDELIA Lingerie is not obliged to reimburse additional costs if you have expressly chosen a more expensive delivery method than the standard delivery method offered by CORDELIA Lingerie. The return costs are your responsibility, as well as any shipping overcharges (specific shipping cost linked to the nature of certain items which cannot normally be returned by post).

Article 12: Intellectual property

The entire site is protected by French and international laws relating to intellectual property. All reproduction rights are reserved. All the texts making up the pages of this site may not, in accordance with the provisions of the intellectual property code, be the subject of any representation or reproduction, in whole or in part, on any medium whatsoever, without the express and prior authorization from CORDELIA Lingerie. Likewise, the brands, trade names and logos appearing on this site are registered. Their total or partial reproduction, made from elements of the site is prohibited. The User who has a personal website and who wishes to place, for personal use, on his site a simple link direct to the home page of the CORDELIA Lingerie brand site, must request it. 'authorization to CORDELIA - 9 rue de Paris - 03200 VICHY by post or email contact@cordelia-lingerie.com. Any other link whatsoever (in particular using the technique of framing or in-line linking) is excluded.

Article 13: Personal data

CORDELIA Lingerie is responsible for the processing and collection of compulsory personal data. This collected data is necessary for the processing, monitoring and delivery of your order, as well as for preparing invoices. On the other hand, this data may be necessary to send, offers, news or advertisements, personalized or not, only if these are accepted. They may also be used for carrying out statistical analyzes. CORDELIA ensures that it takes all the necessary measures, in accordance with the Data Protection Act of January 6, 1978 and the General Data Protection Regulations (RGPD) of April 27, 2016, to ensure the protection, confidentiality and security of data personal. Article 14: Cookies

When consulting the www.cordelia-lingerie.com site, cookies are placed on the User's computer, mobile or tablet. A cookie is a text file deposited during the visit of a site or the consultation of an advertisement. Its purpose is to collect information relating to your navigation and to send you services adapted to your terminal, in order to improve your browsing experience. Article 15: Completeness

In the event that one of the clauses of this contract is null and void by a change in legislation, regulations or by a court decision, this cannot affect the validity and compliance with the other clauses present within the conditions terms of sale.

Article 16: Duration

These conditions apply throughout the duration of online services offered by CORDELIA Lingerie, and are subject to change.

Article 17: Liability

CORDELIA Lingerie is responsible for the proper performance of the obligations resulting from these general conditions of sale. CORDELIA Lingerie will not, however, be responsible for the total or partial non-performance of its obligations under this contract, if this non-performance results either from the buyer or from a case of force majeure as defined in article 1218 of the Civil Code. In the event of force majeure, the Parties agree to consult as soon as possible in order to determine the methods of processing the order during the duration of the case of force majeure. At the end of a period of one month interruption due to force majeure, the Parties will be released from their obligations to each other. Otherwise, CORDELIA Lingerie will reimburse the Buyer the amount of his order as soon as possible. CORDELIA Lingerie cannot also be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or in fact qualified as force majeure, in accordance case law.

Article 18: Applicable law and disputes

These general conditions of sale are subject to French law. Any disputes that may arise about the validity, interpretation, execution or termination of this contract will be subject to the jurisdiction of the French courts, notwithstanding plurality of defendants and / or call in warranty, even for procedures emergency or protective procedures in summary proceedings or by request. The competent court in the event of litigation will be that of PARIS. In addition, in accordance with articles L 152-2 et seq.
